Withdrawal from the contract 

If you are a so-called ‘privileged buyer’, that is to say:

A) a consumer

or

B) a natural person for whom the contract you have entered into with us is directly related to your business activities, but is not of a professional nature for you

- as a general rule, you have the right to withdraw from a distance contract.

You may withdraw from the contract by sending us a notice of withdrawal, for example by email to: zamowienia@lullalove.com. You may withdraw from the contract within 14 days.

 The 14-day period for withdrawing from the contract begins:

for a contract under which we supply goods and are obliged to transfer ownership of them

• from the moment you, or a third party designated by you (other than the carrier), take possession of the goods; and in the case of a contract covering multiple goods that are delivered separately, in batches or in parts
• from the moment you take possession of the last good, batch or part;
  for digital content
• from the date the contract is concluded.

 To meet the deadline, it is sufficient to send the notice before it expires.

Please return the goods to us without delay to the following address: ul. Batalionów Chłopskich 21, 43-514 Kaniów, but no later than 14 days from the date on which you withdrew from the contract

We will refund the payments you have made without delay in accordance with the terms set out in the Shop’s Terms and Conditions, but no later than 14 days from the date on which we receive your notice of withdrawal from the contract.

If we have not offered to collect the goods from you ourselves, we may withhold the refund of the payment received from you until we have received the goods back or you have provided proof of their return – whichever occurs first.

Please note that you are not entitled to the right to withdraw from a distance contract in the case of, amongst other things, the following types of contract:

• where the subject of the supply is a non-prefabricated item, manufactured to your specifications or designed to meet your individual needs;
  where the subject of the supply is an item that is liable to deteriorate rapidly or has a short shelf life;
• where the subject of the supply is goods delivered in sealed packaging which, once opened, cannot be returned for health or hygiene reasons, provided that the packaging was opened after delivery;
• where the subject matter of the supply is audio or video recordings or computer software supplied in sealed packaging, if the packaging has been opened after delivery;
• for the supply of digital content which is not supplied on a tangible medium, for which you are obliged to pay a price, provided that all of the following conditions are met:
  
  • we have commenced the provision of the service with your express and prior consent,
  • we informed you before the service began that, once it had been provided, you would lose your right to withdraw from the contract, and you acknowledged this,
  • we have provided you with a legally valid confirmation of the conclusion of the distance contract, including information on the aforementioned consent, on a durable medium within a reasonable time after the conclusion of the contract, and at the latest before the service begins.

Free delivery on orders over 299 zł is a promotional offer, and to qualify for it, you must purchase products totalling at least 299 zł (including VAT). In the event of a partial return of goods, the conditions for the promotion must still be met.

Returns and free gifts depend on the value of the order:

1. If a Customer has made a purchase entitling them to a free gift (e.g. as part of a promotion based on the order value) and subsequently returns part of the order, thereby reducing its value below the amount required to qualify for the free gift, the Customer is obliged to return the free gift in its original condition, together with the returned goods.
2. If the free gift is not returned, the Seller reserves the right to deduct the value of the free gift from the refund amount, calculated on the basis of its retail price (if it is available for sale) or the value stated in the promotion description.
3. Free gifts must be returned in accordance with the returns procedure set out in the shop’s terms and conditions. Free gifts must be returned in the same condition as they were delivered – unused and in their original packaging (where applicable).
4. This provision applies only to promotions in which the offer of a free gift was conditional on the value of the order. It does not apply to free gifts added to orders regardless of their value.
   
   

Complaints

The following information applies to so-called ‘privileged buyers’. If you are not one, please refer to our Shop Terms and Conditions for detailed information on complaints.

Should we fail to fulfil the contract we have entered into with you correctly, you have the right to make a complaint – preferably by email to: zamowienia@lullalove.com or by post to: ul. Batalionów Chłopskich 21, 43-514 Kaniów.

GOODS

As a general rule, we are liable for any lack of conformity of the goods with the contract that existed at the time of delivery and which becomes apparent within two years of that time.

Under the provisions of the Consumer Rights Act, you may, in such circumstances, request:

a) a replacement of the goods

or

b) have the goods repaired.

In some cases, you may also:

a) withdraw from the contract

or

b) request a price reduction

DIGITAL CONTENT 

We are liable for any lack of conformity of the digital content with the contract which existed at the time of delivery and became apparent within two years of that time.

If the digital content does not comply with the contract, you may request:

a) that it be brought into compliance with the contract,

and, in certain cases, make a claim for:

b) a price reduction

or

c) withdrawal from the contract.
